Appeal of extraordinary sentence welcomed by RCNI

The Rape Crisis Network Ireland (RCNI), welcome the Director of Public Prosecution’s (DPP) decision to appeal Adam Keane’s suspended sentence for rape.

Kate Mulkerrins, RCNI Legal Coordinator said, ‘in the RCNI’s opinion the appeal of this sentence is appropriate given that we feel a three year suspended sentence totally departed from sentencing principles. We are heartened by DPP’s record of referring such sentences to the Court of Criminal Appeal (CCA). The DPP has used his powers in this matter effectively in the past and has been successful in overturning sentences in two thirds of all cases he send forward.

While the RCNI welcome the effective use of the DPPs powers in referring this case to the CCA, the need to instigate a sentencing guideline regime is nevertheless urgent. Mary Shannon should never have had to bear the heavy burden of the injustice of this sentence. The Court of Criminal Appeal should not delay in this matter any longer.’
